1. You are 18 years of age or older and possess the right to enter into this agreement and use our services in accordance with all the terms and conditions of this agreement.
2. The terms and conditions of this agreement are solely to offer you access to our services (including site and mobile applications) for both Clients (Cargo Owners) and Transporters.
3. Both clients and transporters submit requests via KagoAfrica and can track cargo from the initial of loading the cargo to the destination designated by the Client.
4. We are entitled to modify requests or deny you access to our Services at any time.
5. We reserve the right to suspend or discontinue services with or without notice.
6. We shall not be liable to you, your company or any other third party for modification, suspension or discontinuance of our Services.

License to Use KagoAfrica Services

1. KagoAfrica license is solely limited, revocable and non-transferable license to access and use the Services to make legitimate requests by fulfilling the services for haulage end to end operations and for no other purposes.
2. You shall only use our Services for intended purposes, as permitted by this Agreement, and only in accordance with applicable federal, state or local laws, codes, rules, regulations or orders of any governmental authority (“Applicable Law”). Any rights not expressly granted to you herein are reserved by us.

Limitation on Your Use of Services

Using of our product restricts you to encourage or authorize any third party to, directly or indirectly, access or use the services to do any of the following (each, a ‘Misuse”):

1. distribute, sell/resell, license/sublicense, rent or lease the Services, or outsourcing offering or otherwise access or use the Services other than as expressly permitted by KagoAfrica;
2. make any fictitious, fraudulent, or abusive request;
3. distribute any data/information or material that degrades, embarrasses, harasses, humiliates, or threatens any individual or group of individuals;
4. abuse, stalk, or otherwise violate others’ legal rights, including but not limited to rights of privacy and publicity;
5. Download or upload files that you know, or reasonably should know, cannot be legally distributed through the Services;
6. Modify, copy adapt, translate, enhance or improvements of the Services or any part, feature, function or user interface;
7. frame or copy any part of the Services;
8. access the Services in order to build a competitive product or service, or for purposes of monitoring its availability, performance or functionality, or for any other benchmarking or competitive purposes;
9. reverse engineer, disassemble, decompile, decode or otherwise attempt to derive or gain access to the source code of the Services or any component thereof, except to the extent permitted by Applicable Law;
10. Collect information from the Services (including information about other users of the Services or offerings, products or services available on or through the Services) using an automated software tool or manually on a mass basis;
11. integrate or link to any open-source software or freeware with the Services;

KagoAfrica Account Credentials

While account credentials are proprietary to KagoAfrica, you must take precautions to ensure the security of your KagoAfrica account credentials. We assume no responsibility for and will not be liable in an event that a third party interferes with your account credentials and uses it to access your KagoAfrica account. Ensure to provide accurate and up to date information during the registration process.

Account Termination

KagoAfrica may terminate your account at any time, for no reason, or any reason and without notice, including violating this agreement. We may permanently delete all your information that we may have on file including your credentials without any liability whatsoever.

KagoAfrica protects the privacy of your information in its possession. KagoAfrica incorporates certain rules to make every reasonable effort to protect private information and maintain its accuracy and completeness.

We ensure to safeguard and prevent unauthorized access to your private information (including User Content), we cannot be responsible for the acts of those who gain unauthorized access, and we make no warranty, express, implied, or otherwise, that we will prevent unauthorized access to your private information or User Content.
